The Cordova Bend Property Owners Association is a non-profit Texas Corporation. Like all residential property associations (POA's) in the state, Chapter 209 of the Texas Property Code directs the rights and responsibilities that ours and all POAs in Texas must adhere to.

In addition to state and federal laws, the Cordova Bend POA has recorded governing documents that all owners are obligated to follow. These documents are linked below:

By Laws & Certificate of Formation

Our community bylaws are the formation rules for the Association. They outline the general scope and establish general administrative procedures for the Association.

 

Examples of topics include how many board members the association will have and what the board's duties & responsibilities include. 

Policies & Recorded Filings

These documents include items put into effect by the POA's Board of Directors. These items are easily amended on an as-needed basis by the current board.

DCCRs
Declaration of Covenants, Conditions, & Restrictions.

The 'DCCRs' are county-recorded (declared) documents and are, in essence, the rules of our community. They describe the POA's obligations and rights to our owners (members) and vice versa. Commonly, they are often referred to as 'association covenants' or simply 'covenants.'

 

Our community DCCRs require an affirmative vote of the majority of the owners (greater than 50%) to change (ref section 8.3 of the DCCRs).

 

However, during the time the declarant (aka developer) was in control of the Association (through March, 2022), several DCCR amendments were made and remain in effect. Recorded DCCRs are linked below:

Reserve Studies
Community Reserve Studies

Reserve Studies are important reports performed every 3-5 years assessing our community's expected cost approach for maintaining necessary infrastructure. This includes roads/bridge, gates, the park and other Association-owed property. The report is prepared by a company who is an expert in civil engineering and budgeting.

 

The POA board sets the budget and association dues annually and looks to the most current Reserve Study when deciding on dues for the upcoming year. The current DCCRs cap annual dues increases at 18% year-to-year (2019 Amendment).

The cost for maintaining our current infrastructure is the primary driver for the establishment of annual owner assessments. All owners are encouraged to review the most current Reserve Studies report. This report can be found in the owner log-in portal of the AMG web site.
